Terms of Service

These terms govern access to and use of Sendiphany by schools and their staff. By creating an account or using Sendiphany, you agree to these terms on behalf of your school.

1. Beta service

Sendiphany is currently offered as an early-beta product. Features may change, and you may encounter bugs or interruptions. We will do our best to communicate significant changes and to protect the integrity of your data, but the service is provided without warranty of uninterrupted availability during this beta period.

2. Accounts and access

Access is provided per school. School administrators are responsible for managing staff access within their organisation, including revoking access when a staff member leaves. You must keep account credentials confidential and notify us promptly of any suspected unauthorised access.

3. Acceptable use

You agree not to:

• Use Sendiphany for any purpose other than legitimate SEND administration for your school.
• Attempt to access data belonging to another school or another pupil without authorisation.
• Upload unlawful content or content you do not have the right to process.
• Interfere with, reverse-engineer, or attempt to bypass the platform's security controls.

4. AI-generated content

Sendiphany uses AI to help draft EHCP content. AI drafts are a starting point only and must be reviewed, verified, and approved by a qualified member of school staff before being relied upon or shared externally. Sendiphany is not responsible for inaccuracies in AI-generated drafts that are not corrected during human review.

5. Data protection

Our respective data protection obligations, including Sendiphany's role as a data processor for pupil records, are set out in our Data Processing Agreement and Privacy Policy, both incorporated into these terms.

6. Subscriptions and billing

Paid plans are billed in advance on a recurring basis via our payment provider, Stripe. You may cancel at any time from your billing settings; access continues until the end of the current billing period. Trial periods, where offered, do not require payment details unless stated otherwise at sign-up.

7. Limitation of liability

To the extent permitted by law, Sendiphany's liability for losses arising from use of the platform is limited to the fees paid by your school in the twelve months preceding the claim, save for liability that cannot be excluded by law (including death, personal injury, or fraud).
